General Rental Conditions of the Kanaren 24 GbR

The following general switching conditions apply to the legal relationship between the Kanaren 24 GbR and the customer.

§ 1 General


(1) The Kanaren 24 GbR is solely as an intermediary third party services. It mediates the conclusion of a contract for renting a holiday chosen by the client between the owner and the client, as well as the provision of other tourist services with the suppliers.

(2) The legal relationship between the Kanaren 24 GbR and the customer, the provisions of pecuniary agency find (§§ 675.631 et seq) apply, unless these General Booking Conditions provide otherwise.

§ 2: Conclusion of the brokerage contract

§ 3: Obligations of the Kanaren 24 GbR under the agency agreement

(1) The contractual obligation of the Kanaren 24 GbR is limited to the mediation of the offer accommodation or other tourist services, where these are available.

(2) The Kanaren 24 GbR accepts for the owner / provider handling the booking and sending the booking confirmation if the customer receives this not directly by the owner / operator or has agreed with this other.

(3) The Kanaren 24 GbR advises the customer to take out travel insurance. Such insurance is not included in the specified (rental) rates.

(4) The Kanaren 24 GbR is entitled and obliged to pass on the information provided by the customer's personal data to the owner / provider, if this is necessary for the settlement of the resulting contract.

(5) The indications in the Kanaren 24 GbR to passport, visa, currency and health regulations apply exclusively to German nationals. Customers are not German citizens, call for clarification of related questions, please contact the relevant consulate.

§ 4 Customer obligations under the agency agreement

(1) The customer is obliged to inform Kanaren 24 GbR truthful and complete all booking relevant circumstances and his wishes concerning the rental and other tourism services in the Canaries immediately notify any change of address to Kanaren 24 GbR.

(2) The customer shall be responsible for compliance with the contractual obligations of all registered by the residents of rental and enrolled participants to other tourism services.

§ 5: Liability of the Kanaren 24 GbR

(1) The Kanaren 24 GbR is only liable for intentional and grossly negligent acts of its employees, agents and legal representatives or a breach of a contractual obligation.

(2) The liability of the Kanaren 24 GbR as an intermediary is for slight negligence for damages to the customer, which are not physical damages to the foreseeable damage, maximum to a sum corresponding to the price of the reserved by the customer performance.

(3) Liability for offers and services of third parties is not covered by the Kanaren 24 GbR. The Kanaren 24 GbR receives the detailed information contained in the object descriptions of the owners of the rentals or other providers of tourist services and has no way to check them for accuracy. Therefore, the Kanaren 24 GbR makes no representation or guarantee the accuracy, completeness or timeliness of such information.

(4) The Kanaren 24 GbR is not liable for the availability and lack of freedom of the chosen by the client rental and for all special requests, which has provided during the reservation request of the customer, as well as availability and free of defects selected by the customer other tourist services.

§ 6 Limitation of claims from the agent contract


All claims for damages of the customer expire within a period of one year after its creation. This does not apply to claims for tortious act.

§ 7 Representation of the owner

(1) The Kanaren 24 GbR represents the owner in the initiation and conclusion of a contract for renting the chosen by the client or the rental of other contractors in the initiation and the connection of a contract for any other tourist services.

(2) To the extent determined by the owner / contractor it to the customer, the Canaries 24 GbR to accept (partial) payment of the customer is entitled. You sent the booking confirmation on behalf of the owner / operator.

§ 8 Customer payments

(1) The situation resulting from the property description deposit is to be paid by the customer within 3 working days to the Kanaren 24 GbR as representative of the owner / operator.

(2) For the Time of payment of payment on the account of the Kanaren 24 GbR shall prevail. Payment of the full price, if so agreed between the customer and the owner / provider otherwise, no later than four weeks prior to rental / performance start to the owner / provider.

(3) If the booking is made less than four weeks before the start of the rental period, the customer makes the payment according to the instructions of the owner / operator.

§ 9 reservation change by the customer

(1) The Kanaren 24 GbR currently calculated otherwise no separate fees for the provision of holiday accommodation and other tourist services. The future calculation of brokerage fees remains - by express reference - reserved.

§ 10 prices and services

(1) The Kanaren 24 GbR has no influence on price or performance changes mediated holiday or other tourism services.

(2) The Kanaren 24 GbR may require the payment of the difference from the customer, unless a price increase has been effectively agreed between the owner and the customer.

§ 11 Other provisions

(1) the application of German law is agreed between the Kanaren 24 GbR and the customer.

(2) Should any part of the agency contract and the general conditions of the mediation Kanaren 24 GbR does not invalidate the entire contract. If any items are or become invalid, then the parties agree, in this respect to make a legally binding new regulations, which corresponds economically to what have the parties intended.
